Terms of Service

1. Acceptance
By creating an account, accessing, or using HighConvertingEmails (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service. If you are accessing the Service on behalf of an organization, you represent that you have authority to bind that organization.
2. Use of the Service
You may use the Service to generate, score, and refine email content for legitimate business purposes, subject to our Acceptable Use Policy. You agree not to use the Service to (a) violate any law or third-party rights, (b) send unsolicited bulk email or spam, (c) impersonate any person or entity, (d) attempt to reverse engineer, decompile, or otherwise extract the source code of the Service, (e) interfere with the operation of the Service or other users' use, or (f) use the Service to train any competing model or service.
3. Account and security
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any suspected unauthorized access. We may suspend or terminate accounts that violate these Terms or the Acceptable Use Policy.
4. Payment, plans, and renewal
Paid plans are billed monthly or annually in advance. Charges are non-refundable except as required by law or as explicitly offered by us in writing. Subscriptions auto-renew at the end of each billing period unless canceled before renewal. We will give 30 days' written notice (via email) before any price change affecting your plan.
5. Your content
You retain ownership of all content you submit to the Service (email drafts, templates, brand voice samples). You grant us a limited, worldwide, royalty-free license to process and store your content for the sole purpose of providing the Service to you. We do not use your content to train AI models, and our AI sub-processor (Anthropic) confirms in its API terms that your inputs are not used for training.
6. Our intellectual property
The Service, including its software, templates we provide, scoring rubrics, and brand assets, are owned by us and protected by intellectual property laws. We grant you a non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.
7. Warranties and disclaimers
The Service is provided "as is" and "as available." We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate, suitable for any purpose, or free of objectionable content. You are responsible for reviewing and approving all output before using it.
8. Limitation of liability
To the maximum extent permitted by law, our aggregate liability arising out of or related to these Terms or the Service will not exceed the amount you paid us in the twelve (12) months immediately preceding the claim. We will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or business opportunities, even if advised of the possibility of such damages.
9. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any third-party rights, or (d) the content you submit to the Service.
10. Termination
You may terminate your account at any time via account settings. We may suspend or terminate your access immediately for material breach of these Terms or the Acceptable Use Policy. On termination, your right to use the Service ceases; provisions intended to survive termination (warranties, limitations of liability, indemnification, dispute resolution) survive.
11. Governing law and disputes
These Terms are governed by the laws of [JURISDICTION], without regard to conflict-of-law principles. Disputes will be resolved in the courts of [JURISDICTION] unless otherwise required by applicable consumer-protection law. Each party waives any right to a jury trial.
12. Changes to these Terms
We may update these Terms occasionally. Material changes will be announced via email at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
